OCCUPATIONAL HEALTH & SAFETY
This area of the law, the intent of which is to protect Canadian workers from needless danger
in the workplace, is one of mixed federal and provincial jurisdiction. For the most part, provin-
cial health and safety legislation governs workplaces that are subject to provincial regulation,
while some specif‌ic federal statutes govern some industries (e.g., the Atomic Energy Control
Act, which applies in all workplaces involved in the provision of atomic energy). A major com-
ponent of this area of law is WHMIS (Workplace Hazardous Materials Information System).
WHMIS is an initiative that was collaboratively undertaken by the federal government, the
provinces, and major labour unions to ensure that workers are aware of any and all hazardous
materials in their workplace and to keep current all information in the workplace about the
handling of hazardous materials. Related topics: EMPLOYMENT LAW, ENVIRONMENTAL
LAW, HUMAN RESOURCES LAW, LABOUR LAW, NUISANCE, TRANSPORTATION LAW.
